1. Acceptance of Terms

Welcome to VetScouter. These Terms of Use (“Terms”) are a legally binding agreement between you and VetScouter governing your access to and use of the website at vetscouter.com and any related services (collectively, the “Site”).

By accessing or using the Site you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, you must not use the Site.

2. Eligibility

You must be at least 18 years old to submit a review, add a listing, or otherwise contribute content to VetScouter.

If you are using the Site on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

VetScouter is intended for use by residents of the United States.

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You must not:

4. User-Submitted Content — General

By submitting User Content, you grant VetScouter a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, distribute, adapt, and publish your User Content in connection with operating and promoting the Site.

You retain ownership of your User Content. By submitting User Content, you represent and warrant that you own the content or have all necessary rights to submit it, the content does not infringe third-party rights, and the content is accurate and based on your own genuine, first-hand experience.

VetScouter reserves the right to review, remove, or refuse any User Content at any time, at our sole discretion. See our Moderation Policy for details.

5. Reviews & Ratings

Reviews must comply with our Moderation Policy. Key requirements: first-hand experience only, no conflicts of interest, truthful content, original authorship, and you must be 18 or older.

Incentivised reviews

Neither practices nor reviewers may offer, solicit, or accept any material benefit in exchange for a review. Undisclosed incentivised reviews violate these Terms and may also violate FTC guidelines (16 CFR Part 255).

Reviewer liability

You are personally responsible for the content of your reviews. A review containing false statements of fact about a private individual may constitute defamation and expose you to personal legal liability.

6. Vet Listings

Any user may submit a new veterinary practice listing or suggest a correction to an existing listing. By doing so, you represent that the information you are providing is accurate to the best of your knowledge.

We reserve the right to reject, edit, merge, or remove any listing at our sole discretion.

7. Practice Owner & Business Use

Practices must not write, solicit, or incentivise reviews of their own practice; selectively invite only satisfied clients to leave reviews; offer any benefit in exchange for a review; or threaten legal action against a reviewer for leaving an honest review.

Consumer Alert

Practices found to have systematically manipulated their reviews may have a Consumer Alert notice placed on their profile, visible to all users of the Site.

8. Intellectual Property

The VetScouter name, logo, site design, and content created by VetScouter are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, redistribute, or commercially exploit VetScouter Content without our prior written consent.

9. Copyright Claims (DMCA)

We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). To submit a DMCA notice, email hello@vetscouter.com (Subject: “DMCA Notice”) with a description of the work, its location on the Site, your contact information, and a statement of good-faith belief under penalty of perjury.

10. Third-Party Links & Services

The Site may contain links to third-party websites. These links are provided for convenience only. VetScouter does not endorse or assume responsibility for the content or practices of any third-party site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy. Reviewers may request deletion of their reviews and associated personal data by contacting us at hello@vetscouter.com.

12. No Veterinary or Medical Advice

VetScouter is an informational platform. Nothing on the Site constitutes veterinary, medical, or professional advice of any kind. VetScouter does not verify the credentials, licensure, or qualifications of any veterinary practice or individual listed on the Site.

In a pet emergency, contact a licensed veterinarian or emergency animal hospital directly. Do not rely on reviews or ratings to make time-sensitive emergency care decisions.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, VETSCOUTER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VETSCOUTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TO THE EXTENT VETSCOUTER IS FOUND LIABLE FOR ANY CLAIM, OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless VetScouter and its operators from any claims, liabilities, damages, losses, costs, and expenses arising from your use of the Site, User Content you submit, or your violation of these Terms.

16. Termination & Suspension

VetScouter reserves the right to suspend or permanently restrict your ability to submit content to the Site — without notice and without liability — for any conduct that violates these Terms or our Moderation Policy.

17. Dispute Resolution & Governing Law

These Terms are governed by the laws of the United States. Before initiating any formal legal proceeding, you agree to first contact us at hello@vetscouter.com and give us 30 days to attempt to resolve the dispute informally.

YOU AND VETSCOUTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

VetScouter operates as an interactive computer service as defined by 47 U.S.C. § 230 and is not liable as the publisher or speaker of user-generated content submitted by third parties.

18. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms.

19. General Provisions

These Terms, together with our Privacy Policy and Moderation Policy, constitute the entire agreement between you and VetScouter regarding your use of the Site. If any provision is found invalid or unenforceable, the remaining provisions continue in full force and effect.
